General conditions of sale
Buyer's obligations
The Customer is strictly prohibited from providing false and/or fictitious information during the registration process required to initiate the execution of this sales agreement and any related communications; the personal details and email address must be exclusively real personal data.
For orders placed through the website www.barberocioccolato.it, the information contained in the General Conditions of Sale must be viewed and accepted by the Customer before sending the purchase order.
Acceptance will be confirmed by checking the appropriate box on the website. Failure to do so will prevent the order from being processed.
Failure to deliver
Delivery requires the customer or a designated representative to be present at the address indicated on the order.
If the customer or the person in charge is absent or insolvent, the customer will be charged (including on subsequent purchases) for the cost of delivery, any inventory, and the cost of products no longer transferable to third parties.
Shipping methods
Shipping methods for those placing direct orders with Barbero Cioccolato srl will be via express courier, using couriers chosen at the company's discretion.
You can use the order tracking function to obtain information on the delivery status.
Although the courier will provide your telephone number to contact you, we cannot guarantee that you will be contacted by phone as the shipping service is external to our systems and therefore telephone contact will be made solely at the discretion of the driver who will physically handle the delivery.
We also specify that in the standard service it is not possible to indicate any preferred delivery time slots.
Delivery times will be one business week from order acceptance. If there are any issues, including external causes, that may result in longer delivery times, customer service will promptly inform the customer.
Shipping costs
The shipping cost is a fixed €9.00 for purchases under €90.

Payment Methods
The payment methods for those who place a direct order will be:
- Credit card;
- Satispay;
- Advance bank transfer;
- Cash on delivery, with an additional €5 charge as a collection fee.
Barbero Cioccolato srl reserves the right to take appropriate action to collect the debt, including instructing specialized collection agencies, charging late payment interest, charging legal fees, and changing payment terms. It is understood that delivery of the products will be subject to payment by the Customer of the relevant price using the payment methods made available by Barbero Cioccolato srl.
Returns management and right of withdrawal
Right of Withdrawal
Pursuant to Legislative Decree 206/2005 and subsequent amendments, concerning the protection of consumers in distance contracts, Barbero Cioccolato srl informs the Customer that:
a) the Customer may exercise the right of withdrawal within 14 days of receiving the ordered goods for any reason, without the need to provide explanations and without any penalty;
b) only Customers who purchase the goods for purposes other than their own business or professional activity may exercise the right of withdrawal, providing their tax code and not their VAT number for invoicing;
c) the right of withdrawal must be exercised by the Customer, within the term indicated in point a), by communicating it to Barbero cioccolato srl via email to info@barberocioccolato.it or by registered mail with return receipt, sent to the company's registered office, located in Corso L. Einaudi 38/e 12062, Cherasco (CN).
The right of withdrawal is excluded in the following cases, pursuant to art. 59 of Legislative Decree 21/2014:
- order of Products packaged to measure or clearly personalized;
- ordering Products that are liable to deteriorate or expire rapidly;
- order of sealed Products which are not suitable for return for hygiene reasons or reasons related to the
health protection or which have been opened after delivery.
The withdrawal declaration communicated by the customer must necessarily contain:
a) a clear and precise reference to the order for which you wish to exercise the right of withdrawal;
b) the express declaration of the Customer's will to withdraw in whole or in part from the purchase contract;
c) the description and code of the products to which the wish to withdraw refers;
d) the bank details relating to the current account where the Customer intends to receive the relevant refunds, which will be made via bank transfer.
Communication of withdrawal
The Customer may exercise the right of withdrawal by sending a specific declaration to Barbero Cioccolato srl via email to info@barberocioccolato.it or by registered mail with return receipt.
Customer Obligations
The Customer undertakes to appropriately store and safeguard the products for which he intends to exercise the right of withdrawal, keeping them intact in their original packaging together with all accessories and documentation with which they are accompanied.
The Customer agrees to return the products for which the right of withdrawal has been exercised within 15 days of communicating their intention to withdraw. The products must be shipped at the customer's expense to the Seller's operational headquarters, namely Barbero Cioccolato Srl, Corso L. Einaudi 38/e 12062 Cherasco (CN), Italy. Returns of products that are not intact, damaged, or missing components and/or accessories, including documentation, will not be accepted by the Seller, which will return the goods to the Customer, subject to additional shipping costs. In such circumstances, the Customer will not be able to exercise the right of withdrawal.
Reimbursement
Barbero Cioccolato srl will refund the customer the value of the products for which the right of withdrawal was exercised, excluding any shipping costs, within 14 days of receiving the goods, in accordance with the terms and conditions set out above. Return shipping costs are the customer's responsibility.
The refund will be made via bank transfer and it will be the Customer's responsibility to provide the bank details to which the refund will be sent (account holder, name and address of the bank, and IBAN) no later than 14 days after notification of withdrawal from the contract.
Damage and deterioration
Under no circumstances may the Customer exercise the right of withdrawal if the goods are damaged and/or deteriorated.
If the product you wish to return has already been consumed/partially consumed, or has been opened or is no longer suitable for resale, please contact the manufacturer as we cannot accept this type of return.
Return
Guaranteed refund or free replacement of defective or non-compliant products.
No complaints will be considered after 14 days from receipt of the goods and if the material is not returned in its original packaging. Should these requirements not be met, the goods will be returned to the sender, freight collect. For anything not expressly provided for in these general conditions, the provisions of the Italian Civil Code will apply. Barbero Cioccolato srl reserves the right to make any changes to the original commercial offer without obligation or prior notice.
Storage conditions
The products offered for sale include storage conditions listed in the technical data sheet available on the product sales page. These conditions must be respected to ensure proper product preservation.
Goods control
The Customer and/or the person designated by the Customer to collect the goods will be required to check, upon delivery and in the presence of the carrier, the integrity of the delivered packages and their relative number, reporting any discrepancies in the number and/or integrity of the packages in writing to info@barberocioccolato.it.
PRODUCTS
- The product images and information contained in the information sheets correspond to the actual characteristics of the products.
- The customer is required to always check the information provided on the product before consuming or using it.
- The products will not be provided on a trial basis.
- The Customer will be responsible for choosing the products ordered.
- The information provided on or through this site is intended for general information purposes only and is not intended to be a substitute for professional advice.
- Decisions based on such information are made by the user at his own risk and on his own behalf.
No rights can be derived from the information contained on this site.
BILLING
To receive an invoice, you must have entered your billing information at the time of purchase. Otherwise, we will not be able to issue invoices upon customer request after the sale.
ELECTRONIC PAYMENTS
Payments made by credit card or other electronic means will be processed via a secure connection using the Stripe service. Customers will pay for purchases with their credit card without sharing their financial information with Barbero Cioccolato srl, which therefore cannot be held responsible for any fraudulent use of the card in question.
PROBLEMS NAVIGATING THE SITE
The Customer must independently equip themselves with suitable equipment and software to connect to the Internet. If the Customer is unable to view part or all of the www.barberocioccolato.it website, Barbero Cioccolato srl will not be held liable. Barbero Cioccolato srl does not guarantee that the www.barberocioccolato.it website will function without errors or interruptions. Uses of this website that could prevent its use by other Internet users, compromise its functionality, and/or affect the information provided on or through the website or the underlying software are prohibited. Barbero Cioccolato srl will not be held liable for any damages, direct or indirect, resulting in any way from access to this website and/or (from the use of) information provided on or through the website.
Barbero Cioccolato srl reserves the right to change the information provided on or through the website www.barberocioccolato.it, including the terms of this Disclaimer, at any time and without notice. Barbero Cioccolato srl is not responsible for the content of external websites that link to this site or that link to it.
RESOLUTION
The parties will have the right to terminate the order agreement with immediate effect in the event of non-fulfillment, even partial, of the other party's obligations by written notice sent to the other party via registered mail with acknowledgement of receipt. Barbero Cioccolato srl also reserves the right to refuse any subsequent orders from the defaulting Customer, and reserves the right to take legal action to protect its rights.
FORCE MAJEURE
Barbero Cioccolato srl will not be held liable to the Customer for delays or failure to fulfill contractual obligations caused, directly or indirectly, by force majeure beyond its control, such as: particularly intense natural phenomena, acts of war, strikes, unforeseen restrictions ordered by authorities, etc. In such cases, the affected party will promptly notify Barbero Cioccolato srl. In any case of force majeure, the parties will have the right to cancel the order or request its performance within a deadline to be determined.
LIMITATIONS OF LIABILITY
Barbero Cioccolato srl assumes no responsibility for any disruptions attributable to force majeure which prevent, in whole or in part, the execution of the sales agreement within the agreed timeframe.
Barbero Cioccolato srl will not be liable to any party for damages, losses, and costs incurred as a result of the failure to execute the sales agreement for the reasons mentioned above, or for damages, losses, and costs incurred as a result of the use or inability to use the purchased products. The Customer is only entitled to a refund of the price paid, excluding any shipping costs.
Barbero Cioccolato srl cannot be held responsible for any loss or damage suffered by the Customer due to delays, slowdowns, or interruptions in the e-commerce service, if such events are not dependent on its conduct or are caused by the malfunction of telecommunications services.
Barbero Cioccolato srl cannot be held responsible for delays in fulfilling the purchase order or for the failure to fulfill it, if such situations are caused by impediments beyond its control.
Barbero Cioccolato srl is not responsible for damage caused by improper use of the products on the site.
SUSPENSION OF SERVICE
Barbero Cioccolato srl reserves the right to suspend all or part of the website's functionality, in accordance with its efficiency and security requirements. In such cases, Barbero Cioccolato srl, except in cases of particular urgency, will notify customers by any means deemed appropriate and as soon as possible.
JURISDICTION AND APPLICABLE LAW
The sales contract between Barbero Cioccolato and the Customer is deemed to have been concluded in Italy and is governed by Italian law. Any civil or criminal disputes arising from this distance selling contract shall be subject to the exclusive jurisdiction of the Court of Asti.
ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
By placing an order through any of the available methods, the Customer declares having read all the information provided during the purchase process and fully accepts the General Conditions and Payment Terms. Therefore, pursuant to Articles 1341 and 1342 of the Italian Civil Code, the Customer declares having carefully read the General Conditions above in their entirety and, after careful review, expressly accepts all of them.
